Criminal Referral Defense

Failing to secure coverage is insurance fraud under section 440.105(4). We defend the referral before it becomes a charge.

Under section 440.105(4)(a)3 and (4)(f), Florida Statutes, knowingly failing to secure workers' compensation coverage is a third-degree felony, a second-degree felony when the monetary value is $20,000 or more, and a first-degree felony at $100,000 or more. Referrals go to the Division of Investigative and Forensic Services and then to the State Attorney. We intervene early, with a former investigator's understanding of how these cases are built.
